What changed The White House Section 232 proclamation on unmanned aircraft systems (UAS) was published in the Federal Register on August 19, 2026 (FR Doc. 2026-16979), locking in effective dates. Effective for goods entered for consumption on or after 12:01 a.m. ET September 3, 2026, subchapter III of chapter 99 of the HTSUS is modified per Annex IV, and the rate is 100% for UAS, docking stations and critical components in Annex I, and 25% for UAS in Annex II.
A separate 25% tariff on certain UAS components listed in Annex III takes effect on February 9, 2027.
The duties apply in addition to other applicable duties, taxes, fees, and charges unless the proclamation provides otherwise.
Who's affected Drone importers, e-commerce sellers of consumer/commercial UAS, ag/inspection/public-safety operators, and FTZ users. The 100% rate covers drones with a maximum takeoff weight greater than 25 kg, drones with thermal imaging, UAS docking stations, and certain critical components identified in Annex I.
A 25% tariff applies to qualifying UAS with a maximum takeoff weight of 25 kilograms or less. Scope sits in HTSUS Chapter 99 (subchapter III) linked to underlying drone/parts classifications — check your exact HTS against Annexes I–III.
Cost impact
Section 232 tariffs of 100% apply to high-risk UAS and docking stations, and 25% to consumer and commercial drones under 25 kg, effective September 3, 2026. Country caps cut exposure: qualifying products from Japan, South Korea, Taiwan, Switzerland, Liechtenstein, and the EU have a maximum duty rate of 15%, and qualifying UK products a maximum of 10%. But the caps are conditional — the 15% and 10% caps apply only where importers certify that "substantially all" critical components originate from qualifying countries, a standard Commerce has not yet defined. Per-unit effect depends on your customs value and which annex/tier your SKU falls in.
What to do 1. Pull every drone/parts SKU and map its HTS against Annexes I, II, and III; flag anything landing before/after Sept 3. 2. Re-quote landed cost on affected SKUs at 100% or 25% — and model the 15%/10% caps only if you can document origin. 3. Clear in-transit UAS entries for consumption before 12:01 a.m. ET Sept 3 to avoid the new duties. 4. Check the Blue UAS grace path: for companies on the DoW Blue UAS Cleared List, Blue UAS Framework, or FCC Conditional Approval List on September 2, 2026, the tariffs instead take effect 180 days after the proclamation for qualifying listed products and components.
5. If you'll certify allied-country origin for the caps, start assembling "substantially all" component-origin documentation now. 6. Watch for CBP CSMS implementation guidance (HTS 9903 codes, filing mechanics) before Sept 3.
