What changed
The Bureau of Industry and Security (BIS) published a notice in the Federal Register on August 6, 2026 proposing to include 14 additional derivative articles within the scope of Section 232 duties on steel, aluminum, and copper, with comments due by August 27, 2026. This is a proposed scope expansion, not yet in effect — but the comment window is short and closes in under three weeks. The docket is BIS-2026-0331 (XRIN 0694-XC166) on regulations.gov.
Note this is separate from the standing Section 232 inclusions process, which runs in two-week windows three times per year with decisions in 60 days.
Who's affected Importers, brokers, and FTZ operators handling metal-intensive finished and semi-finished goods. The 14 proposed additions: aluminum powder; brass-wind musical instruments and their parts/accessories; parts of welding machines and apparatus; floor safes; certain electric conductor cables; fire extinguishers; parts of heat exchange units; parts of certain hydraulic engines and motors; certain self-propelled cranes, mobile lifting frames, and straddle carriers; tanker trailers and semi-trailers; self-loading/self-unloading trailers and semi-trailers for agricultural purposes; certain other trailers and semi-trailers; and certain filled steel containers.
The filled steel containers include those holding propane, oxygen, or propylene.
Cost impact
Most of these products would be subject to a 25% tariff if included, although certain products would be subject to different rates under existing proclamations. The exact per-line rate depends on final HTS scope and metal composition. Under the current framework, articles made primarily of steel, aluminum, or copper are subject to a 50% ad valorem duty on full value, while derivative articles identified in the annexes are generally subject to a 25% ad valorem duty, also applied to full value.
Since April 6, 2026, Section 232 duties are assessed on the full customs value of covered products rather than only the metal content — so if a product is added, duty is owed on the entire entered value, not just the metal portion. No per-unit figure can be quantified until final HTS lines and effective dates publish.
What to do 1. Pull your product master and flag any SKUs matching the 14 categories above — especially trailers/semi-trailers, cranes/lifting equipment, welding-machine parts, heat-exchanger parts, and filled steel containers. 2. Identify the specific HTS lines you import in these categories and map them against the notice's proposed scope on regulations.gov (Docket BIS-2026-0331). 3. If affected, draft and file a comment before August 27, 2026 — BIS is seeking data on metal content, import volumes, domestic production capacity, and potential economic effects.
4. Re-quote landed cost on affected SKUs at a 25%-on-full-value assumption so you're not surprised if the rule finalizes. 5. FTZ operators: prepare for privileged-foreign-status treatment on affected goods if these lines finalize, consistent with existing Section 232 admissions rules. 6. Coordinate with suppliers now to document metal content and origin in case a content-based analysis is required.
